Terms & Condition

Rates
Rates are quoted as daily, weekly or as periodical rates. Rates for each accommodation reflect the maximum occupancy – additional guests are subject to per person per day charge. Rates are for 2009/2010 and are occasionally, if rarely, subject to changes without prior notice. Your rental comes with the facilities listed on the relevant web page from which you first observed. Please go to that web page to fully familiarize yourself with the items included with the rental of your choice. Please observe the peak season additional.

Reservations & Payments
Payment of the deposit and a fully completed guest reservation form must be received and approved by us, unless otherwise directed, before a confirmation will be issued. No grace periods are granted.

We must receive final payment, consisting of the remainder of the rental balance at least 30 days prior to guest arrival – except where the rules and obligations of deposit for the rental are specified differently and time period between booking and arrival is too short. In this case the final payment is due at arrival at the premises. Failure to make final payment(s) on a timely basis will result in an automatic cancellation of the reservation.

We will accept and hold a tentative reservation for seven days after initial booking.

Unless otherwise stated a minimum deposit of 50% is required. The final balance is then due and must be received at least 30 days prior to guest arrival (or together with the with the reservation form if booked less than 60 days in advance of arrival). Failure to make final payment(s) on a timely basis will result in an automatic cancellation of the reservation.

Payment Requirements
All payments to be made via telegraphic transfer to our account or by Visa & MasterCard only.
Final approval of the reservation request is subject to clearance of payment.

Credit card payment
Booking forms for payment by credit card are sent to you from us. We don’t normally accept credit card payment unless accompanied by a signed approval of the charge(s) by the client. If the amount owed exceeds a limit of US$ 500.00 then payment should be made by telegraphic transfer. All charges or costs incurred are the clients’ responsibility and the clients should specify “Full Amount” when making payment by bank transfer. The booking cannot be confirmed until we have received full payment.

We accept only Visa & MasterCard cards. Since our merchant account is on Bali all credit card transactions will be converted from any foreign currency into Indonesian Rupiah using the prevailing bank exchange rate of the day of transaction.
Final approvals of all reservation requests are subject to clearance of payment.

Cancellation Policy
Refunds on cancellations for any reasons whatsoever are not provided beyond that which is covered in the cancellation policy as stated below. To protect against cancellation caused by unforeseen events, such as illness, strikes, last minute cancellations, Acts of God and more; we recommend those guests purchase trip cancellation insurance to insure refund of deposits paid.

Cancellation Fees
25 % of the total booking price if the cancellation occurs from the first day after the booking has been made until 90 days prior to the beginning of the rental period, less wiring fees (US$ 40).

35 % of the total booking price for cancellations occurring between the 89th and the 60th day prior to the beginning of the rental period less wiring fees (US$ 40).

50 % of the total booking price for cancellations occurring between the 59th and the 30th day before arrival.
100% of the total booking price for cancellations after day 30 before arrival

If you have to cancel, exchanging your stay for a future stays is possible, subject to availability and acceptance. There may be additional charges for villa price increases and administration fees.

Booking Confirmation
Once you have paid your balance a booking confirmation voucher will be issued. You should bring this voucher when checking in at the villa. Your booking voucher confirms which villa you booked, for how long and what facilities will be included in the rental fee. Please study this voucher once you receive it to check that all the details are correct. If you have any questions, please contact our reservations department.

Timings for Checking In Out
The check out time in all villas is typically 12:00 hours.

As with any good hotel these timings provide the staff at the villas with enough time to prepare for incoming guests. If you have an evening departure flight and would like book a late checkout then it is advisable to inform us when completing the booking form.

A late checkout is possible subject to availability. A late checkout up until 16:00 hours is generally possible and free of charge, after this time the rates are as follows.

Late check out between 16:00 hours and 18:00 hours will be charged at 25% the daily rate.
Late check out between 18:00 and 20:00 hours will be charged at 50% of the daily rate.

Additional Charges
Rates do not include long distance or local calls and facsimile messages. Internet is provided free of charge but guests have no claim if the connection is not available. . Excessive cleaning upon departure (including but not limited to cleaning of upholstery, shampooing of the rugs, breakage, soiling or damage to the interior or exterior caused strictly by applicant) may be subject to further charges.

Additional charges for a Car & Driver
Some of our packages provide a car and driver for your convenience during your stay. This service is a bonus and is available to you free of charge for up to 8 hours per day, unless otherwise specified. For car and driver rented on the spot and which are not part of a package the same rules apply.

At the end of each day your driver will ask you to sign his worksheet. Extra hours over and above your 8 hours are charged at Rp. 50.000,- per hour. This applies up until midnight which is the latest we can ask our drivers to work.

Between midnight and 06:00hrs the 8 hours no longer applies instead the rental rate for a car and driver is Rp. 100.000,- per hour.

Your 8 hours are calculated from the time you order the driver to pick you up each day.

Billing for overtime will be calculated at the end of your stay and an invoice presented to you before checking out. Please pay this invoice promptly and do not try to barter the rate down as this is a fixed fee.

Our Guarantee
When you reserve and pay for a villa directly with us we guarantee (as accredited member of the Bali Villa Association) your villa will be available for you upon arrival in accordance to these “Terms & Conditions.” If for some unforeseen reason the villa is not available to you because it is either destroyed or uninhabitable due to structural damage. If there is irreparable damage to essential equipment such as electrical systems, plumbing or the villa is rented to another party by error, or is uninhabitable because it is not in working order per these “Terms & Conditions”, we will immediately attempt to find another villa of similar qualities, cost and size. Failing this, a 100% refund will be provided to the client. If only a portion of the rental time is rebooked then a pro rata refund will be made. Any rental payment that qualifies for a refund either whole or pro rata will be subject to an administration fee equivalent to 15% of the total booking.

Please note Indonesia as with most other countries does from time to time suffer from power failure due mainly to essential work on the main grid. Although it happens very seldom, we cannot be held responsible for such failures as these are deemed to be outside our control. Occasionally a power surge will shut off the circuit breaker. This does not mean that there has been a power failure, only that a breaker in the house has been triggered. It needs to be switched back on. Similar to the U.S.A. and other European countries, the panel is normally inside the house.

We will not provide a refund if electricity is lost temporarily due to a breaker being triggered and or power failure.
However with a handyman 24 hours on service and an emergency generator unit on standby, we never experience power failures of more than 5 minutes.

Liability for Amenities & Non Essential Items
We will not be held liable nor provide refund, partial or otherwise for amenities not provided for reasons outside of our control. “Amenities” examples are TVs, DVDs, private telephones and incidental appliances. Amenities do not include water, electricity. The villa descriptions are accurate and updated as currently as possible.

General Liability
Under no circumstance shall the owners be responsible for any personal loss by individuals renting the accommodations offered by the owners. Expenses, claims, or injury, direct or indirect, caused or incurred before, during or after the party’s stay in the accommodations including attorney’s fees the owners will not be held liable and will be otherwise rendered harmless for any events arising in law as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of accommodations or services provided for reasons of military action, acts of terrorism, revolutions and Acts of God or by any agents, employees, sub contractors, servants or third parties whatsoever supplying any of the services herein.

You agree to indemnify and hold the owners harmless for any claims arising from a violation of the Terms & Conditions of this agreement or of any third party claims. The owners have the full discretion to refuse or discontinue service to any person or agent, and/or rescind any contract for accommodations of guest services. The owners will not be held liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services as described in these “Terms & Conditions”.

These “Terms & Conditions” are the conditions, which will govern the reservations of all villa accommodations.

Modification and Acknowledgement
We may modify any of the items contained in these Terms & Conditions at any time and in our sole discretion, by posting a change notice or a new agreement on our site. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the program following our posting of a change notice or new agreement on our site will constitute binding acceptance of the change.

You acknowledge that you have read this agreement and agree to all its terms and conditions as currently in effect and as amended from time to time. You have independently evaluated the desirability of your chosen rental and are not relying on any representation, guarantee, or statement other than as set forth in this agreement.

Miscellaneous
The laws of Indonesia will govern this Agreement, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the courts of Indonesia and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent.

Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. You acknowledge that you have agreed to be bound by these Terms and Conditions of this Agreement whether electronically or otherwise, you further acknowledge that you have received, understand and agreed to this Agreement.
